BY PARTICIPATING IN THIS PROGRAM DURING THE PROGRAM PERIOD, YOU AGREE TO THESE OFFICIAL RULES, WHICH ARE A CONTRACT, SO READ THEM CAREFULLY BEFORE ENTERING. AMONG OTHER THINGS, THIS CONTRACT INCLUDES INDEMNITIES FROM YOU TO THE PROGRAM ENTITIES (DEFINED BELOW) AND A LIMITATION OF YOUR RIGHTS AND REMEDIES.
The "Danone Oikos Pro Alcaraz Promotion" (the "Program") is sponsored and administered by Danone Canada, 100, rue de Lauzon, Boucherville, QC J4B 1E6 (the "Sponsor" or the “Administrator). By participating in the Program, you agree to be bound by these Rules and the final and binding decisions of the Sponsor and Administrator in all matters relating to the Program.
The clock of the Administrator (defined below) is the official time-keeping device in the Program.
1. PROGRAM PERIOD
The Program commences at 12:00:01 AM Eastern Time ("ET") on July 8, 2026 and ends at 11:59:59 PM ET on September 13, 2026 (the "Program Period"). All entries must be received during the Program Period. Entries submitted before the commencement or after the close of the Program Period will not be accepted.
For the purposes of these Rules, a "day" means a twenty-four (24) hour period beginning at 12:00:01 AM ET and ending at 11:59:59 PM ET during the Program Period. The sole determinant of time for all purposes under these Rules is the Administrator's server clock.
2. ELIGIBILITY
The Program is open only to legal residents of Canada who have reached the age of majority in their province or territory of residence at the time of their first entry (each eligible individual, a "Participant" or "Member"). The following individuals are ineligible to participate in the Program (collectively, "Excluded Persons"):
Employees, directors, officers, representatives, agents and contractors of: (i) the Sponsor; (ii) the Administrator; (iii) any parent companies, affiliates, subsidiaries or related entities of the Sponsor or Administrator; (iv) any advertising, promotional, creative, digital, media, fulfilment or other agencies involved in any way in the development, execution or administration of the Program; and (v) any persons or entities involved in judging, evaluating or adjudicating any aspect of the Program; and
All members of the immediate family or household of any person set out in (a) above, regardless of where they reside. For purposes of these Rules, "immediate family" means spouse or common-law partner, parent, step-parent, sibling, step-sibling, child or step-child.
Groups, clubs, organizations, businesses and commercial or non-commercial entities are not eligible to participate. Each Participant must enter the Program on their own behalf and in their own name.
A Participant must meet all eligibility requirements throughout the Program Period and at the time they are confirmed as a winner, if applicable.
If it is discovered by the Sponsor or Administrator (using any evidence or other information made available to or otherwise discovered by them) that any person has attempted to use multiple names, multiple identities, and/or any automated, macro, script, robotic or other system(s) or program(s), and/or any other means not in keeping with the Sponsor's interpretation of the letter and spirit of these Rules, to enter or otherwise participate in or to disrupt the Program, then that person may be disqualified from the Program in the sole and absolute discretion of the Sponsor. The Sponsor and Administrator (and each of their respective parent companies, affiliates, subsidiaries, advertising and promotional agencies, prize suppliers, and their respective officers, directors, employees, agents and representatives) (collectively, the "Program Entities") are not responsible for, and accept no liability whatsoever in relation to, any late, lost, misdirected, delayed or incomplete submissions (all of which are void).
3. HOW TO EARN POINTS
NO PURCHASE NECESSARY. Purchase is not required to enter the Program and will not improve your chances of winning.
The Program is a points-based promotion. Participants earn points ("Points") by completing eligible activities as described in this Section 3. Points accumulate in a Participant's registered online account (the "Account") at the Program's website located at www.beatalcaraz.com (the "Program Website").
To participate in the Program, you must first register a free Account at the Program Website. Account registration is required for all activities, including Instant Win Game plays. To register, visit the Program Website and thereafter follow the on-screen instructions at the Program Website during the Program Period, providing your full legal name, email address, country and province or territory of residence and confirming that you have reached the legal age of majority in your province or territory of residence at the time of registration.
One (1) Account per person. Limit of one (1) Account per person and per email address. If it is determined, in the sole and absolute discretion of the Sponsor or Administrator, that the same individual has registered multiple Accounts (including through use of multiple email addresses), all such Accounts and any associated Points, entries and prizes may be voided and the individual may be disqualified.
You are responsible for maintaining the security and confidentiality of your Account login credentials and accept full responsibility for all activity occurring under your Account. In the event of a dispute as to the identity of a Participant, the Account will be deemed to belong to the authorized holder of the email address used at registration.
General Points Rules (applicable to all earning activities below):
No monetary value: Points have no monetary or cash value and may not be redeemed for cash under any circumstances.
Non-transferable: Points are personal to your Account and may not be transferred, assigned, or pooled with another Account.
Points deduction on redemption — Important: When you redeem Points for a Tier Prize (see Section 6), the Points required for that redemption are permanently deducted from your Account balance. This may reduce your tier level and will reduce your standing in the Grand Prize competition (see Section 7). Participants who wish to maximize their Grand Prize eligibility are advised to consider this trade-off when redeeming any Tier Prize.
Forfeiture: All unredeemed Points are forfeited at the close of the Program Period (11:59:59 PM ET on September 13, 2026).
Fraud: The Sponsor reserves the right to invalidate Points earned through fraudulent, unauthorized or non-compliant means.
(A) Account Registration — 100 Points (one-time Registration Bonus)
Upon successful registration of your Account during the Program Period, you will be credited with a one-time "Registration Bonus" of one hundred (100) Points. The Registration Bonus is credited once per eligible Participant for the entire Program Period, regardless of the number of subsequent logins or Account sessions.
(B) Purchase Activities — Points per Qualifying Product
To earn Points by making a purchase (a "Purchase Entry"), take the following steps during the Program Period:
Purchase one (1) or more qualifying Oikos Pro products (each, a "Qualifying Product", listed below) from any eligible Canadian retailer where the Qualifying Products are available for purchase (each, an "Eligible Retailer", listed in Schedule A).
Retain your original purchase receipt.
Log in to your Account at the Program Website and follow the on-screen instructions to upload a legible image of your purchase receipt (a "Receipt"). Your Receipt must clearly identify: the Eligible Retailer; the date of purchase; the Qualifying Product(s) purchased; and the price paid.
Upon submission and verification of a valid Purchase Entry, you: (i) will earn Points in accordance with the schedule below:

Limit of three (3) Purchase Entries per person per day throughout the Program Period, subject to the Daily Entry Limit in Section 3(E). For clarification, each Qualifying Product corresponds to one (1) Purchase Entry, regardless of the nature of the Qualifying Product and the number of Qualifying Products on any one (1) Receipt.
Retain your original Receipt(s). The Sponsor or Administrator may request your original Receipt at any time. Failure to produce the original Receipt upon request may result in disqualification and forfeiture of any associated Points or prizes.
(C) Written Entries — Points per Written Entry (no purchase required)
To earn Points without making a purchase, you may submit up to three (3) written entries (each, a "Written Entry") per day during the Program Period, as described in more detail below. To do so, log in to your Account at the Program Website and follow the on-screen instructions to submit a Written Entry. The three (3) Written Entries available each day are as follows: (i) first Written Entry - the Essay Entry: a short-form written response of no more than fifty (50) words in response to that day's rotating daily prompt (an “Essay Entry”); and (ii) second and (iii) third Written Entries – the Multiple-Choice Question Entries : each an answer to a multiple-choice question selected at random from a pool of questions generated by the Sponsor (each a “Multiple-Choice Question Entry”).
For clarification:
Each Essay Entry must be: (i) original work written entirely by you; (ii) not previously published or submitted elsewhere; (iii) free of offensive, defamatory, obscene or otherwise inappropriate content as determined in the Sponsor's sole discretion; and (iv) submitted in English or French.
None of the available responses to the multiple-choice questions for the Multiple-Choice Question Entry constitutes a correct or incorrect answer. Any response submitted will be considered valid and will not influence the number of points awarded.
Upon submission and verification of a valid Essay Entry or Multiple-Choice Question Entry, you: (i) will earn one hundred (100) Points.
Limit of three (3) Written Entries per person per day (one (1) Essay Entry and two (2) Multiple-Choice Question Entries) throughout the Program Period, subject to the Daily Entry Limit in Section 3(E). Written Entries submitted in excess of these limits will be disqualified.
(D) Social Sharing Activities — 50 Points per Successful Referral
Once you have created your Account , a unique personal referral link to participate to the Program (your "Referral Link") will be generated and made available in your Account. You may share your Referral Link with friends and family via any lawful means.
You (the "Referring Participant") will earn fifty (50) Points for each person (a "Referred Person") who: (i) clicks your Referral Link; (ii) successfully registers an Account during the Program Period; and (iii) thereafter submits at least one (1) valid Purchase Entry or Written Entry during the Program Period. Points will be credited to the Referring Participant's Account only upon satisfaction of all three (3) conditions.
Limit of four (4) successful referrals per Referring Participant throughout the Program Period, for a maximum of two hundred (200) Points from Social Sharing Activities for the Program Period. No further Points will be credited after four successful referrals are achieved. A Referred Person may only be attributed to one (1) Referring Participant.
Referring Participants may not refer themselves. Referrals of ineligible individuals, or referrals generated through automated means, are void.
(E) Daily Entry Limits
Daily Entry Limit: The following combined daily limits applies to all earning activities per Participant:
Maximum three (3) entries per day, across Purchase Entries and Written Entries combined, in any combination of Purchase Entries and Written Entries (for example: three (3) Purchase Entries and zero (0) Written Entries; two (2) Purchase Entries and one (1) Written Entry; one (1) Purchase Entry and two (2) Written Entries; or zero (0) Purchase Entries and three (3) Written Entries).
Social Sharing Activities are not subject to a separate daily limit. Limit of four (4) successful referrals throughout the Program Period.
Entries submitted in excess of the applicable daily limit will be disqualified and will not earn Points.
(F) Important Notes
Retain your original Receipt(s). The Sponsor or Administrator may request your original Receipt at any time. Failure to produce the original Receipt upon request may result in disqualification and forfeiture of any associated Points or prizes.
By participating through either method of entry, you agree to these Rules and to the decisions of the Sponsor and Administrator, which are final and binding in all respects.
Where you use a mobile device to access the Program, data rates may apply. Please consult with your mobile device service provider regarding rate plans.
Any available opt-in opportunities are not required to enter this Program and checking any opt-in boxes will not improve your chances of winning.
All Entries are subject to verification at any time. The Sponsor reserves the right, in its sole and absolute discretion, to require proof of identity and/or eligibility from any entrant, including without limitation the original Receipt submitted with a Purchase Entry, which proof shall be in the form required by the Sponsor. Failure to provide proof of identity and/or eligibility to the satisfaction of the Sponsor in a timely manner may result in disqualification.

The Instant Win Prizes operate independently of the Points mechanism. Winning or not winning an Instant Win Prize has no effect on a Participant's Points balance or tier standing.
(B) Instant Win Prizes Limits
Limit of one (1) Instant Win Prize per Participant throughout the Program Period. Once a Participant wins an Instant Win Prize, they may continue to submit Entries and participate in the points-based activities for the remainder of the Program Period but will not win a further Instant Win Prize.
The Instant Win Prizes operate independently of the Points mechanism. Winning or not winning an Instant Win Prize has no effect on a Participant's Points balance or tier standing.
The Sponsor and/or its representatives may respond to entrants or otherwise engage with Program Participants during the Program Period, but such interactions will have no impact on the process through which Instant Win Prizes are awarded in accordance with these Rules.
(C) Winning Times Mechanics
All Instant Win Prizes will be awarded based on random computer-generated Winning Times (defined below). Winning Times are distributed at random intervals throughout the Program Period and are not disclosed to Participants. The approximate odds of winning an Instant Win Prize depend on the randomly-generated Winning Times, the number of eligible Entries received and the times at which those Entries are received. The number of Instant Win Prizes available to be won will decrease throughout the Program Period as they are randomly awarded.
Two thousand eight hundred (2,800) random computer-generated date and time combinations along with the applicable Instant Win Prize category will be generated and selected at the outset of this Program using a computerized randomizer program for each Instant Win Prize available to be won (each, a “Winning Time”). The first eligible Entry to be received following each random computer-generated Winning Time will receive the applicable Instant Win Prize message and corresponding fulfillment instructions.
(D) Unawarded or Unclaimed Instant Win Prizes
If at the end of the Program Period there are any unawarded or unclaimed Instant Win Prizes, the Sponsor reserves the right, in its sole and absolute discretion to award such Instant Win Prizes through a random draw from amongst all eligible Entries, at a date beyond the Program Period, or to withdraw the unclaimed prizes.
In the event that a technical or other error results in more Instant Win Prizes being claimed in any category than the number available, the Sponsor reserves the right to rescind invalid claims and/or conduct a random draw from eligible claimants to award the correct number of prizes.
(E) Instant Win Prize Notification
As described in more details in Section 8 of these Rules, Instant Win Prize winners are notified immediately via an on-screen message at the Program Website upon their winning. Further fulfilment instructions will be provided at that time.
5. TIER PRIZES
Tiered Structure
The Program features a tiered structure. Using the methods of entry outlined above in the Rules, you will accumulate Points that are redeemable for prizes and progress through the following five (5) tiers (each, a "Tier"). Your current Tier is determined by your current Points balance at any given time (i.e., after deducting any Points redeemed for Tier Prizes):

Your Tier is displayed in your Account at all times. As you accumulate Points, your Tier advances automatically; no further action is required to progress to a higher Tier.
Tiers 1 to 4 Prize Redemption
Once you redeem a Tier Prize, the required Points are permanently deducted from your balance, which may cause your Tier level to decrease.
Once you have attained a new Tier, only Tier prizes from your current Tier and the Tier immediately below it remain available for redemption. You may not redeem a Tier prize from a Tier more than one (1) Tier below your current Tier. For clarity, if your Tier level decreases as a result of a Tier Prize redemption, prize availability is determined based on your new (post-redemption) Tier level. In the event that a Tier Prize becomes unavailable or is out of stock with the source retailer, the Sponsor reserves the right to provide a suitable alternative of equal or greater value or issue a gift card of equivalent value.
Information regarding notification to Tier Prize winners and verification requirements are set out in Section 8 of these Rules.
Tier Prizes are available in limited quantities and redeemable on a first-come, first-served basis. Redemption of a Tier Prize is subject to availability and these Rules.
Grand Prize Eligibility - Important: Attaining Tier 5 does not mean that you will automatically win the Grand Prize. The Grand Prize will be awarded as described in Section 6.

Tier Prizes Limits
Tier Prizes are available in limited quantities and redeemable on a first-come, first-served basis. Redemption of a Tier Prize is subject to availability and these Rules.
Grand Prize Eligibility - Important: Attaining Tier 5 does not mean that you will automatically win the Grand Prize. The Grand Prize will be awarded as described in Section 6.
If due to production, online, internet, computer or other error of any kind, more Tier Prizes, in any Category, are claimed than intended to be distributed or awarded according to these Rules, then, the Sponsor reserves the right, in its sole and absolute discretion, to rescind invalid Prize claims and/or conduct a random draw from amongst all eligible Prize claimants to award the correct number of Tier Prizes in each Category. In no event will the Sponsor be liable for more than the number of Tier Prizes in any Category as stated in these Rules.
The Sponsor and/or its representatives may respond to entrants or otherwise engage with Contest participants during the Contest Period, but such interactions will have no impact on the process through which Prizes are awarded in accordance with these Rules.
Unawarded or Unclaimed Tier Prizes
If at the end of the Program Period there are any unawarded or unclaimed Tier Prizes, the Sponsor reserves the right, in its sole and absolute discretion, to award such Tier Prizes through a random draw from amongst all eligible Entries, at a date beyond the Program Period, or to withdraw the unclaimed prizes.
In the event that a technical or other error results in more Tier Prizes being claimed in any category than the number available, the Sponsor reserves the right to rescind invalid claims and/or conduct a random draw from eligible claimants to award the correct number of prizes.
6. TIER 5 PRIZE – THE GRAND PRIZE
There is one (1) Grand Prize available, which will be awarded to the registered Participant who has the highest total accumulated Points balance in their Account at 11:59:59 PM ET on September 13, 2026 (the end of the Program Period).
Grand Prize Potential Winner Declaration
The Grand Prize will be awarded to the registered participant with the highest total Points balance in their Account at the end of the Program Period, at 11:59:59 PM ET on September 13, 2026, in accordance with the Rules. One (1) potential Grand Prize winner will be declared by the Administrator on 09/16/2026.
Grand Prize Description
There is 1 Grand Prize consisting of a meet-and-greet trip with Carlos Alcaraz in France or Spain (date and details subject to Carlos Alcaraz’s availability) for one (1) person (the Participant declared as the Grand Prize winner), which includes: round-trip airfare, 4 days/3 nights' in 4-star hotel, ground transportation to & from the hotel and the meet-and-greet venue, and five hundred ($500.00 CAD) Canadian dollars in spending money (the “Grand Prize”). The approximate retail value (“ARV”) of the Grand Prize is ten thousand seven hundred Canadian dollars ($10,700.00 CAD).
For clarification, the date, time, location, and other details of the Grand Prize will be determined by the Sponsor in its sole and absolute discretion, based on the availability of Carlos Alcaraz and other relevant factors, and will be communicated to the Grand Prize winner at a later date. If a potential or declared Grand Prize winner is unavailable to attend the Grand Prize at the date, time, or location selected by the Sponsor, or refuses to travel to or attend the Grand Prize as required, such individual may, at the Sponsor’s sole discretion, be disqualified and will forfeit the Grand Prize in its entirety, without any right to a substitute prize, cash equivalent, or other compensation. In such event, the Sponsor reserves the right to declare the eligible Participant with the next highest total accumulated Points balance at the end of the Program Period, at 11:59:59 PM ET on September 13, 2026, as an alternate potential winner, subject to these Rules. This process shall be repeated, as necessary, with successive alternate potential winners in descending order of total Points balance until a potential winner is successfully confirmed in accordance with these Rules. No difference between the actual and approximate Grand Prize value will be provided.
Grand Prize winner must abide by all venue policies and event terms and conditions. Sponsor reserved the right to revoke the full or partial prize from the winner who it or venue personnel deem, in their sole discretion, may be intoxicated, be a safety risk, have violated any venue policy or law, or may bring the Sponsor or Program Entities into disrepute.
The approximate odds of winning the Grand Prize depend on the total number of eligible Entries received by the Contest Closing Time.
Grand Prize Limits
Limit: One (1) Grand Prize per person and per household. The Grand Prize may not be transferred, assigned or substituted, except at the Sponsor's sole discretion.
Potential Grand Prize Winner Disqualification
The potential winner of the Grand Prize will be notified initially by email beginning within three (3) day of the date on which his/her Entry was selected as a potential winner. If the Administrator is unsuccessful in its attempts to reach and communicate directly with a potential winner by email after two (2) attempts over a two (2)-day period to the email address listed in that potential winner’s Entry form, then, at the Sponsor’s sole and absolute discretion, that potential winner may be disqualified without liability to the Sponsor.
In the event of such a disqualification, the registered Participant who has the next highest total accumulated Points balance in their Account at the end of the Program Period, at 11:59:59 PM ET on September 13, 2026, will be declared the potential winner, subject to these Rules. This process shall be repeated, as necessary, with successive alternate potential winners in descending order of total Points balances until a potential winner is successfully contacted by the Administrator and confirmed to have fulfilled all requirements under these Rules.
Effect of Tier Prize Redemption on Grand Prize Eligibility
Points deducted from a Participant's Account upon redemption of a Tiers 1 to 4 Prize (please refer to Section 5) reduce that Participant's Points balance for Grand Prize purposes. The Grand Prize is determined by the Points balance in the Account at the close of the Program Period, after all redemptions.
Tiebreaker
In the event of a tie (two or more Participants with equal Points balances at the close of the Program Period), the Grand Prize will be awarded to the tied Participant who achieved that Points balance earliest, as determined by the time-stamp on the eligible Entry that caused that Participant's balance to reach the tied level, according to the Administrator's server records. The Administrator's server timestamp is the sole determinant. In the event of any dispute regarding timestamps, the Sponsor's decision is final and binding.
7. PRIZE CONDITIONS
The following conditions apply to all prizes (Instant Win Prizes, Tiers 1 to 4 Prizes and the Grand Prize) awarded under the Program:
All amounts and costs related to any Prizes, including but not limited to all income, sales, use and other taxes (and the reporting thereof) imposed as a result of the award of a Prize, which are not expressly stated as covered by the Sponsor in these Rules are the responsibility of the individual winner. It is the individual winner’s responsibility to understand and abide by any federal, provincial, territorial, local or foreign tax laws that may apply to receipt of a Prize.
A person eligible to win a Prize must accept the Prize as awarded and may not transfer such Prize or substitute or exchange for, or apply the Prize’s value towards, cash or a higher cost or alternative prize. All Prizes are non-refundable, cannot be replaced if lost or stolen and are provided on an “as is” basis, without any representation or warranty of any kind. The Sponsor reserves the right, in its sole and absolute discretion, to make substitutions of equivalent or greater kind or value in the event of the unavailability of all or part of a Prize or for any other reason whatsoever.
If a winner cannot be reached within the notification period, or if a winner fails to satisfy all conditions within the time required, the prize will be forfeited and awarded to an alternate winner (determined by a random draw from remaining eligible entries for Instant Win Prizes, or to the next highest Points-balance Participant for the Grand Prize), or may be withdrawn at the Sponsor's discretion.
Prizes will be shipped to a valid Canadian address, at no cost to the winner (unless otherwise noted). The Sponsor is not responsible for prizes lost, stolen, delayed or damaged in transit.
In the event of a printing, production or other error that results in more prizes being claimed than are available in any category, or that misdescribes a prize, the Sponsor reserves the right to award the correct number of prizes by random draw from eligible claimants, to correct the misdescription, or to withdraw the prize, as the Sponsor deems appropriate in its sole discretion.
Without limiting the foregoing, the following conditions apply to the Grand Prize:
Grand Prize must be accepted as awarded and is not transferable or convertible to cash (no substitutions except at Sponsor’s option).
Specific travel arrangements and all Grand Prize details not specified herein will be made and determined at the Sponsor's sole discretion. Specific dates of travel are subject to the Sponsor's approval, and travel dates are subject to availability; blackout dates and other restrictions may apply. Winner must travel on dates specified by the Sponsor, and the Sponsor is not responsible for any cancellations, delays or changes to travel arrangements beyond its reasonable control. Travel must originate from and end at the same airport. The actual value of the Trip may vary depending on point of departure and fluctuations in the cost of air transportation. all travel arrangements relating to the Grand Prize must be made through the Sponsor or its designated agent.
The Grand Prize winner is responsible for having valid travel documents, including government-issued identification, and must have a valid passport prior to departure.
The Grand Prize winner is responsible for all travel expenses not expressly included herein, including airline baggage fees, gratuities, meals, and any other incidental costs or expenses related to participation in the Grand Prize. Travel insurance is not included and is the winner's sole responsibility, and the Grand Prize winner acknowledges that the Sponsor has not and will not obtain or provide travel insurance or any other form of insurance for any part of the Grand Prize.
The Grand Prize winner will be required to provide a major credit card upon hotel check-in, and all in-room charges will be charged to that credit card. Any damage to the room will be the responsibility of the Grand Prize winner.
If the Grand Prize winner does not utilize any part(s) of the Grand Prize, then any such part(s) not utilized will be forfeited in its entirety and nothing will be substituted in its place.
The Sponsor bears no responsibility if any event, element or detail of the Grand Prize is cancelled, postponed or becomes unavailable for any reason. Should any event, element or detail of the Grand Prize become unavailable, the Sponsor shall have no obligation to the Grand Prize winner aside from providing the remaining portion of the Grand Prize, minus any unavailable event, element or detail. The Sponsor is not responsible if the Grand Prize is delayed, postponed or cancelled for any reason, and no refund or compensation will be paid in the event of the cancellation or delay of the Grand Prize or any portion thereof.
The Sponsor reserves the right at any time to: (a) place reasonable restrictions on the availability or use of the Grand Prize or any component thereof and (b) substitute the Grand Prize or a component thereof for any reason with a prize or a prize component of equal or greater value, including, without limitation, but solely at the Sponsor’s sole discretion, a cash award.
The Grand Prize winner is expected to conduct themselves appropriately, and adherence to all applicable activity rules and guidelines is mandatory. In the event a Grand Prize winner engages in behavior that, as determined by the Sponsor in its sole discretion, is obnoxious or threatening, illegal, or intended to annoy, abuse, threaten or harass any other person, the Sponsor reserves the right to terminate the Grand Prize early, in whole or in part, with no further obligation. In the event a Grand Prize winner engages in behavior that, as determined by the Sponsor in its sole discretion, is illegal or tortious, or subjects the Grand Prize winner to arrest or detention, the Sponsor shall have no obligation to pay any damages, fees, fines, judgments or other costs or expenses of any kind whatsoever incurred by the Grand Prize winner as a result of such conduct.
By accepting the Grand Prize, the winner agrees to waive all recourse against the Releasees (defined below) if the Grand Prize or a component thereof does not prove satisfactory, either in whole or in part, for any reason.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, NEITHER THE SPONSOR NOR ANY PROGRAM ENTITY SHALL HAVE ANY LIABILITY FOR ANY PERSONAL INJURIES, DEATH, PROPERTY DAMAGE, OR OTHER DAMAGES OR EXPENSES RESULTING FROM, ARISING OUT OF, OR RELATED TO THE GRAND PRIZE OR ANY ACTIVITY RELATED TO THE GRAND PRIZE OR ANY OTHER ASPECT OF THE GRAND PRIZE WINNER'S ACCEPTANCE OR USE OF THE GRAND PRIZE. The Grand Prize may be fulfilled by a third-party fulfilment agency. The Grand Prize will only be awarded if properly claimed in accordance with these Rules. All costs and expenses related to the acceptance and/or use of the Grand Prize not expressly specified herein as being provided are the sole responsibility of the Grand Prize winner.
8. WINNER NOTIFICATION AND VERIFICATION
Instant Win Prizes: Winners are notified immediately via an on-screen message at the Program Website. The Sponsor or Administrator may also contact the winner by email to the address associated with their Account. All Instant Win Prize winners must: (i) correctly answer a time-limited mathematical skill-testing question (see Section 9); (ii) execute a Declaration and Release form (see Section 9); and (iii) provide any other information or documentation required by the Administrator, within [3 days] of notification. Failure to respond within the required period may result in disqualification and award to the next eligible Participant.
Tier Prizes: Upon submission of a valid redemption request, the Sponsor or Administrator will contact the winner by email to the address associated with their Account. All Tier Prize winners must: (i) correctly answer a time-limited mathematical skill-testing question (see Section 9); (ii) execute a Declaration and Release form (see Section 9); and (iii) provide any other information or documentation required by the Administrator, within (72) seventy-two hours for Digital prizes and [3 to 10] days for Physical prizes of notification. Failure to respond within the required period may result in disqualification and award to the next eligible Participant.
Grand Prize: Following the close of the Program Period, the Sponsor or Administrator will contact the potential Grand Prize winner by email to the address associated with their Account within three (3) day of the date on which his/her Entry was selected as a potential winner of the Program Period end date. The potential Grand Prize winner must: (i) correctly answer a time-limited mathematical skill-testing question (see Section 9); (ii) execute a Declaration and Release form (see Section 9); and (iii) provide any other documentation or information requested by the Administrator, within [3 days] of notification. Failure to respond within the required period may result in disqualification and award to the next eligible Participant.
All winners may be required to provide government-issued photo identification confirming their identity, age and province of residence, and to produce original purchase Receipts upon request.
The Sponsor and Administrator reserve the right to verify the eligibility of all winners prior to awarding any prize. A potential winner who fails to satisfy any eligibility requirement, fails to correctly answer the skill-testing question, or fails to return all required documentation within the required time period will be disqualified and the prize may be awarded to an alternate.
9. DECLARATION AND RELEASE AND SKILL-TESTING QUESTION
Before being confirmed as a winner of any Prize (Instant Win Prizes, Tier Prizes and the Grand Prize), the potential winner must complete and return, within forty-eight (48) hours of date of receipt, a Declaration and Release Form (the “Declaration and Release”), which (among other things):
Confirms compliance with these Rules;
Acknowledges acceptance of the Prize as awarded;
Releases the Program Entities and each of their respective officers, directors, employees, agents, representatives, successors, and assigns (collectively, the “Releasees”) from any and all liability in connection with this Program, the potential winner’s participation therein and the awarding and use/misuse of the Prize awarded or any portion thereof; and
Confirms the potential winner’s consent to the publication, reproduction and/or other use of his/her name, address, voice, statements about the Program and/or photograph and/or other likeness without further notice or compensation, in any publicity or advertisement carried out by or on behalf of the Sponsor in any manner whatsoever, including, without limitation, print, broadcast and the Internet.
Further, prior to being confirmed as a winner of any Prize (Instant Win Prizes, Tier Prizes and the Grand Prize), each potential winner must also correctly answer a mathematical skill-testing question, which may be contained in the Declaration and Release or administered by the Administrator by telephone, email or online form, at the discretion of the Sponsor, without assistance of any kind, whether mechanical, electronic or otherwise.
If a potential winner fails to return the properly executed Declaration and Release within the specified time period, the Sponsor may, in its sole and absolute discretion, disqualify the potential winner, thereby forfeiting any and all rights the potential winner may have to the awarded Prize. In the event of such a disqualification, an alternate potential winner may be selected from among the remaining eligible Entries, either through a process similar to the one that selected the original potential winner or through a random draw, the exact process to be determined by the Sponsor in its sole and absolute discretion, subject to these Rules.
10. LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, YOU AGREE TO RELEASE, INDEMNIFY AND HOLD HARMLESS THE PROGRAM ENTITIES (THE "RELEASEES") FROM AND AGAINST ANY AND ALL CLAIMS, DAMAGES, LOSSES, COSTS OR EXPENSES (INCLUDING REASONABLE LEGAL FEES) ARISING OUT OF OR RELATING TO: (A) YOUR PARTICIPATION IN THE PROGRAM OR ANY COMPONENT THEREOF; (B) THE AWARD, ACCEPTANCE, USE OR MISUSE OF ANY PRIZE; OR (C) ANY BREACH BY YOU OF THESE RULES. IN NO EVENT SHALL THE AGGREGATE LIABILITY OF THE RELEASEES TO ANY PARTICIPANT EXCEED THE APPROXIMATE RETAIL VALUE OF THE PRIZE WON OR CLAIMED BY THAT PARTICIPANT.
WITHOUT LIMITING THE FOREGOING, THE RELEASEES ARE NOT RESPONSIBLE FOR: (I) ANY LOST, LATE, MISDIRECTED, DELAYED, INCOMPLETE OR ILLEGIBLE ENTRIES OR COMMUNICATIONS; (II) ANY COMPUTER, NETWORK, INTERNET, WEBSITE, HARDWARE OR SOFTWARE MALFUNCTIONS, FAILURES, DIFFICULTIES OR DELAYS OF ANY KIND; (III) ANY FAILURE OF ANY ENTRY TO BE RECEIVED, CAPTURED OR RECORDED FOR ANY REASON, INCLUDING TECHNICAL PROBLEMS OR TRAFFIC CONGESTION ON THE INTERNET OR AT ANY WEBSITE; (IV) ANY INJURY OR DAMAGE TO ANY PERSON'S COMPUTER, MOBILE DEVICE OR OTHER PROPERTY RELATED TO OR RESULTING FROM PARTICIPATING IN THE PROGRAM OR DOWNLOADING ANY MATERIALS FROM THE PROGRAM WEBSITE; OR (V) ANY THIRD-PARTY ACTS OR OMISSIONS.
Nothing in these Rules limits the liability of any Program Entity for fraud, willful misconduct, or any liability that cannot be excluded by law. In Quebec, Section 10 of these Rules applies to the maximum extent permitted by the laws of Quebec, including the Civil Code of Quebec and the Consumer Protection Act (Quebec).
11. GENERAL CONDITIONS
By participating in this Program, Participants agree to abide by and be bound by these Rules and the decisions of the Sponsor and Administrator, which shall be final and binding on all Participants in all matters relating to this Program. In the event a Participant wins a Prize and is later found to be in violation of these Rules, he/she will be required to forfeit the Prize or to reimburse Sponsor for the stated value of the Prize if such violation is discovered after winner has used the Prize. False, fraudulent or deceptive Entries or acts shall render Participants ineligible for the Prize.
Each Participant must submit an Entry and participate in the Program on his/her own behalf. Any Entry submitted on behalf of another individual, on behalf of a group or organization, or using another person’s email address, name or other personal information will be disqualified and ineligible to claim any Prize.
Any attempt by any Participant to obtain more than the specified number of Entries by using (or attempting to use) multiple names, identities, email addresses, registrations, or logins, or by any other means whatsoever, will entitle the Sponsor, in its sole and absolute discretion, to void that Participant’s Entries and disqualify that Participant from the Program. Entries by any means which subvert the entry process will be void. Any Entry form that is determined by the Sponsor, in its sole and absolute discretion, to have failed to have been fully completed and submitted during the Program Period will be rejected. Use (or attempted use) of any automated, macro, script, robotic or other systems or programs to enter or otherwise participate in, subvert, or disrupt the Program, and any other attempt to manipulate, tamper with or defraud any element of this Program, is prohibited and is grounds for disqualification by the Sponsor in its sole and absolute discretion.
In the event of a dispute as to any Entry, the authorized account holder of the email address included in the Entry form for that Entry will be deemed to be the Participant and he/she must be eligible according to these Rules. The “authorized account holder” is the natural person assigned an email address by an Internet access provider, online service provider or other organization responsible for assigning email addresses for the domain associated with the submitted address. All Entries received become the property of the Sponsor and will not be returned or acknowledged.
The sole determinant of the time of receipt of an Entry for the purposes of determining the eligibility of that Entry shall be the Administrator's computer or server.
Proof of sending Entry or Receipt (regardless of method) is not proof of receipt by the Sponsor or Administrator. Incomplete, altered, mutilated, or garbled Entries will be disqualified. The Releasees are not responsible for lost, late, misdirected, garbled, stolen, incomplete, invalid, unintelligible or damaged Entries, or for Entries submitted in a manner that is not expressly allowed under these Rules, or for any Entry not submitted or received due to any technical error or failure, unauthorized human intervention, inaccurate capture or mis-entry of any required information, the effects of hackers, the failure of any electronic equipment, computer transmissions and/or network connections or any other reason beyond Sponsor’s reasonable control; all of which will be disqualified. The Releasees are not responsible for mechanical, technical, electronic, communications, telephone, computer, hardware or software errors, malfunctions or failures of any kind, including, without limitation: failed, incomplete, garbled or delayed transmission of online Entries, traffic congestion on telephone lines, the Internet or at any website or lost or unavailable network connections which may limit an online entrant's ability to participate in the Contest, and any injury or damage to entrant’s or any other person’s computer related to or resulting from participating in or downloading any information necessary to participate in the Contest. Entrants are restricted to the use of ordinary and typical computer equipment and internet access use in respect of the Contest.
The Releasees are not responsible for the cancellation or postponement of any component of this Program or any associated programs and materials. The Releasees are not responsible for any other errors of any kind, whether computer, technical, typographical, printing, human or otherwise, relating to or in connection with the Program. The Releasees are not responsible for typographical or other errors in the offer or administration of this Program, including, without limitation, errors which may occur in connection with the printing or advertising of this Program, these Rules, administration or execution of the Program, the conducting of the Prize drawing or winner selection, the cancellation of any element of a Prize, the processing of Entries or in the selection or announcement of a Prize or Prize winner.
The Sponsor reserves the right to correct typographical errors or other errors in these Rules without changing the material terms of the Program.
The Sponsor reserves the right, in its sole and absolute discretion, to modify, suspend, cancel or terminate the Program at any time, for any reason, upon public notice, including in the event of any cause beyond its reasonable control (including fire, flood, epidemic, pandemic, earthquake, act of government, labour dispute, sabotage, technical failure, cyberattack, unauthorized intervention, website or server outage, or any other occurrence or cause beyond the Sponsor's reasonable control) that prevents or materially impairs the proper administration of the Program. In such event, any Prize not yet awarded may be awarded by random draw from all eligible entries received to the date of cancellation or may be withdrawn.
Sponsor reserves the right to cancel, modify, suspend, or terminate the Program, to change any Program dates and to modify these Rules at any time without notice, for any reason, including, without limitation, if, in the opinion of the Sponsor, in its sole and absolute discretion:
Fraud, misconduct or technical failures destroy or threaten the integrity of any portion of the Program;
A computer virus, bug, or other technical problem corrupts the administration, security, or proper conduct of the Program; or
There is any accident or printing, administrative or other error of any kind related to the Program.
In the event of an early termination of the Program for any reason whatsoever, Sponsor reserves the right to determine the Prize winners in a random drawing from among all eligible, non-suspect Entries received as of the time/date of such termination.
The Sponsor reserves the right, in its sole and absolute discretion, and without prior notice, to adjust any of the dates and/or timeframes stipulated in these Rules, to the extent necessary, for purposes of verifying compliance by any Participant or Entry with these Rules, or as a result of technical problems, or in light of any other circumstances which, in the opinion of the Sponsor, in its sole and absolute discretion, affect the proper administration of the Program as contemplated in these Rules.
The Sponsor may, in its sole and absolute discretion, and without notice, terminate the right of any Participant or user of the Website to participate in the Program or use the Program Website.
As between Participants and the Sponsor, the Sponsor is the sole owner of any Program material and promotional products, as well as intellectual property rights thereto, including, without limitation, software, logos and trademarks and nothing in these Rules shall be construed so as to confer any right whatsoever to Participants in this regard. Nothing herein grants to entrants the right to use the trademarks, copyrights or other intellectual property rights of the Program Entities.
All decisions of the Sponsor and Administrator with respect to all aspects of the Program, including the awarding of prizes, eligibility of entries and interpretation of these Rules, are final and binding on all Participants and are not subject to challenge or appeal, except where prohibited by law.
Any attempt to deliberately damage or undermine the legitimate operation of the Program or the Program Website may be a violation of criminal or civil law. Should any such attempt be made, the Sponsor reserves the right to disqualify any such individual and to seek remedies from that person to the fullest extent permitted by law.
By participating in the Program, except to the extent prohibited by applicable legislation, each Participant:
Consents to the publication, reproduction and/or other use of his/her name, address, voice, statements about the Program and/or photograph and/or other likeness without further notice or compensation, in any publicity or advertisement carried out by or on behalf of the Sponsor in any manner whatsoever, including, without limitation, print, broadcast and the Internet;
Releases and agrees to defend and indemnify the Releasees from and against any and all liability, claims, losses, actions or damages of any kind, whether actual, incidental or consequential, for injury (including but not limited to death), damages, losses or expenses arising out of or relating to a Participant’s participation in this Program, or the acceptance, possession or use/misuse of any Prize or participation in Prize-related activities (including but not limited to activity related thereto);
Agrees not to make any claim against any of the Releasees or against any third party that may result in a claim against any of the Releasees in respect of any matter in any way relating to or arising in connection with the Program; and
Acknowledges and agrees that the Releasees make no warranty, guaranty or representation of any kind concerning any Prize and disclaim any implied warranty.
The Releasees shall not be liable to Prize winners or any other person for failure to supply any Prize or any part thereof by reason of any acts of God, viral or bacterial outbreaks, pandemics, epidemics or similar events, any actions, regulations, orders, or requests by any governmental entity, equipment failure, terrorist acts, war, fire, unusually severe weather, embargo, labour dispute or strike, labour or material shortage, transportation interruption of any kind, or any other cause beyond the reasonable control of the Releasees.
If any provision of these Rules is determined to be invalid or unenforceable, the remaining provisions of these Rules shall otherwise remain in effect and shall be construed in accordance with their terms as if the invalid or unenforceable provision was not contained herein.
These Rules will be made available in both English and French. In the event of any inconsistency between the English and French versions, the English version shall prevail, subject to applicable law in Quebec.

12. PRIVACY
The Sponsor and Administrator respect your right to privacy and works at all times to comply with all applicable data protection and privacy laws. Except as expressly set out in these Rules, in the Sponsor’s Privacy Policy (available at www.danone.ca/privacyhttps://www.danone.ca/privacy-policy/policy)," target="_blank">https://www.danone.ca/privacyhttps://www.danone.ca/privacy-policy/policy), or as otherwise agreed to by you, any personal information provided in connection with this Program will only be collected, used and disclosed by the Sponsor, the Administrator and their third party partners and service providers for the purposes of administering and conducting this Program, including, without limitation, verification of eligibility and identity and awarding and delivering Prizes. Please note that personal information provided as part of this Program may be collected in, transferred to, and processed and stored in jurisdictions outside of Canada. Such information will be subject to the general laws applicable within those jurisdictions, including, without limitation, possible access by regulatory authorities. The Sponsor and Administrator will not sell, share, or otherwise disclose personal information provided in connection with this Program to or with third parties or agents, other than to third parties or agents engaged by the Sponsor or Administrator to fulfill the above purposes or as permitted or required by the applicable laws.
13. GOVERNING LAW
These Rules shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without reference to any conflict of laws principles. Participants agree to the exclusive jurisdiction of the courts of the Province of Ontario for any dispute arising out of or relating to these Rules or the Program, except that residents of Quebec shall have recourse to the courts of the Province of Quebec pursuant to applicable Quebec law.
Notwithstanding the foregoing, the Sponsor makes no representation that the Program is appropriate for participation in any jurisdiction other than Canada, and participation from outside Canada is void.
